Do you need to worry about paying for an IEE?

Requesting an independent educational evaluation (IEE) is like getting a second opinion. If you disagree with the results of the school’s assessment or with your child’s educational placement, an IEE may help your child receive appropriate teaching support.

However, some parents or guardians might hesitate to request an IEE due to cost concerns. If you worry about how to pay for an IEE, here’s what you need to know.

Who pays for an IEE?

According to the Individuals with Disabilities Education Act, parents or guardians of children with disabilities may request an IEE at public expense. Rather than paying out-of-pocket, the school system or district typically pays for the evaluations.

Only one IEE paid at public expense

The school district only pays for one IEE. If you request more, you will shoulder the costs of any further evaluations.

However, parents or guardians may request an IEE for different types of assessments. The assessments include:

  • Psychoeducational evaluations
  • Occupational or physical therapy
  • Assistive technology
  • Speech or language
  • Functional behavior

Cost limits for IEEs

There are no cost limitations for IEEs based on federal or state laws. Still, school districts may set cost caps for IEEs. If the cost containment caps do not actively prevent parents or guardians from requesting an IEE, they are generally permitted.

Reimbursement and other arrangements

School districts may require upfront payments from parents and then provide reimbursement later. If you cannot afford upfront fees, you may be able to negotiate with the school to work out other arrangements.

Even if you can afford to pay for an IEE out-of-pocket, it is still best to request one from the school district first. There is no guarantee you will receive reimbursement if you file your IEE request after the fact.

Speaking with a special education attorney can offer greater clarity about your options. They can also help navigate arrangements with the school or file complaints if necessary.
