Your language access rights during IEP assessments

Individualized Education Programs (IEPs) are legally binding plans designed to meet your child’s unique learning needs. Assessments are necessary to develop these plans, helping you and the school identify your child’s strengths and challenges. As a parent, you are a key part of the process, and you have the right to take part in the decision-making.

However, language can be a barrier, especially for families whose native language is not English. Some educational terms are difficult to understand. It can also make it hard to participate in meetings. This can make navigating assessments and the whole IEP process overwhelming.

You have the right to understand it in your language

Both federal and state laws require schools to make sure that all families can be involved in their child’s IEP process, no matter what language they speak. During assessments, you have the right to:

  • Receive all information about the assessments in your own language: This means the school should provide documents and explanations written in a way you can understand. You should also be able to request translated copies of important IEP documents.
  • Have access to a qualified interpreter: They should be able to help you communicate with teachers and understand the evaluations taking place.
  • Have the option to conduct the assessment in your child’s native language if possible: This guarantees that the results can show what your child truly knows and can do.

Remember that language differences should not hinder your understanding or participation in your child’s educational planning. Schools must provide these services at no cost to you.
